An understanding of the general provisions of tort law is essential to comprehending "Good Samaritan" statutes. In tort law, a person who is not otherwise obligated to do so has no duty to assist someone who has been injured. For example, barring some state law to the contrary, a passing motorist is not legally required to stop at an accident scene to assist the injured, even if he has specialized medical knowledge or training.
